In order to assure the integrity of the Rising Star Awards entries, protection of Fashion Group International, Inc. (“FGI”) and the highest standards for this awards program, FGI requires your authorization and agreement as set forth below. In consideration of the opportunity to participate in the Rising Star Awards, I hereby represent, acknowledge and agree:
The entry(ies) I submit to FGI in connection with the Rising Star Awards (“Entries”) are original and do not infringe on any third-party rights, including, but not limited to, intellectual property rights.
That I grant FGI, its representatives and agents the right to use, including to publish, my name, picture, my likeness, my city and state of residence, and any photographs, motion pictures, recordings, or any other record of my participation in the Rising Star Awards for its record keeping, purposes of trade, publicity or promotion in connection with the Rising Star Awards program without renumeration.
That I hereby grant to FGI, its representatives and agents the right to publish, produce, use, adapt, edit and/or modify Rising Star Award Entries in any manner and in all media in perpetuity, without limitation.
That I hereby irrevocably assign to FGI all rights to Entries including, but not limited to, intellectual property rights appropriate to the rights granted herein.
That I waive, release and forever discharge FGI, its officers, agents, members, representatives, insurers, sponsors and advertisers (collectively, the “Releasees”) from any and all responsibility, claims, rights, damages, causes of action and/or liability with respect to my Entry(ies), participation in the Rising Star Awards and use of rights granted under this agreement, and FGI and the other Releases from and claims, costs, or damages, whether from the negligence of the Releasees or otherwise, resulting from my participation in the Rising Star Awards, my Entry(ies) and/or use of rights granted by this agreement;
To defend, indemnify and hold the Releasees harmless from all claims, causes of action, costs, demands, damages, and expenses, direct, incidental, consequential or otherwise, resulting from my participation in the Rising Star Awards program and the grant of rights hereunder.
I further acknowledge and agree that FGI assumes no liability of any nature for any damage or property loss occurring in connection with any Entries. All nominees are responsible for pick-up of all Entries when notified by FGI.
FGI has no responsibility for lost, misdirected or unseen deliveries, Entries, mail or e-mail.
That the person/designer described in the Entry has a minimum of one year and no more than six years' experience in the industry indicated in the Entry.
I have not been the winner of an award from any other fashion-industry related trade association or any other similar entities nor have I been a prior Rising Star Award winner in the same category in which I am competing.
I will comply with any other rules, regulations, and policies of FGI in connection with the Rising Star Awards.
The terms of this Entry and agreement are acknowledged and agreed by the Nominee or other person authorized in writing by the Nominee to submit the Entry and execute this agreement on Nominee’s behalf
